The fact that Rod and his lawyers admit that he did not comply with 90 day notice period in his counterclaim is pretty strong evidence that the countersuit will be dismissed if WVU brings the appropriate motion. On the other hand, the allegations do have merit regarding to the extent that they focus on material breaches by WVU during the contract.
